Welcome to TrustSignal. These Terms & Conditions (“Terms”) govern your access to and use of the TrustSignal website, platform, APIs, software, communication services, and related products and services (collectively, the “Services”) provided by TrustSignal (“TrustSignal,” “we,” “us,” or “our”).
By accessing our website, creating an account, signing an order form, integrating our APIs, or using any of our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not access or use the Services.
1. Definitions
For the purposes of these Terms:
“Account” means the account created by or for a Customer to access the Services.
“Customer,” “you,” or “your” means the individual, business, organization, or legal entity using the Services.
“Content” means any data, messages, media, templates, files, information, communications, or other material submitted, transmitted, or processed through the Services by or on behalf of the Customer.
“End User” means the recipient or intended recipient of communications sent through the Services.
“Third-Party Services” means services, platforms, networks, carriers, cloud providers, messaging providers, application programming interfaces, or other services operated by third parties.
“Order Form” means any order, commercial proposal, subscription agreement, statement of work, or other commercial document agreed between TrustSignal and the Customer.
2. Eligibility
You represent and warrant that:
- You have the legal capacity and authority to enter into these Terms.
- If you are using the Services on behalf of an organization, you are authorized to bind that organization.
- You will use the Services only for lawful and legitimate business purposes.
- The information provided during registration or onboarding is accurate and complete.
TrustSignal may refuse registration or restrict access where required for legal, regulatory, security, compliance, or operational reasons.
3. Services
TrustSignal provides communication technology and infrastructure services that may include, depending on the Customer’s subscription or Order Form:
- SMS and messaging services;
- WhatsApp Business messaging;
- RCS/RBM messaging;
- Email communication services;
- APIs and SDKs;
- Communication automation;
- Messaging workflows and campaign management;
- Analytics and reporting;
- Customer engagement tools;
- AI-enabled conversational or automation features; and
- Other communication and software services introduced by TrustSignal from time to time.
The specific Services, features, pricing, usage limits, and applicable service levels may be described in an Order Form or applicable service documentation.
TrustSignal may modify, enhance, replace, or discontinue features from time to time, provided that such changes do not materially reduce the core functionality of a paid Service during an applicable subscription period, except where changes are required by a third-party platform, law, regulation, security requirement, or circumstances beyond TrustSignal’s reasonable control.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities performed through your Account.
You must:
- Keep login credentials confidential.
- Use strong and appropriate authentication mechanisms.
- Notify TrustSignal promptly of unauthorized access or suspected security incidents.
- Ensure that employees, contractors, and authorized users comply with these Terms.
- Restrict access to the Services to authorized personnel.
You must not share, sell, transfer, or otherwise provide access to your Account to unauthorized third parties.
TrustSignal may suspend access where it reasonably believes an Account has been compromised or is being used in violation of these Terms.
5. Customer Responsibilities
You are solely responsible for:
- Your use of the Services;
- The accuracy and legality of your Content;
- Obtaining all required permissions, consents, registrations, licenses, and approvals;
- Ensuring that communications sent to End Users comply with applicable laws and regulations;
- Maintaining appropriate records of consent and communication preferences;
- Providing appropriate opt-out and unsubscribe mechanisms where required;
- The products and services promoted through your communications; and
- Your relationship with End Users.
TrustSignal provides communication infrastructure and technology and does not assume responsibility for the legality, accuracy, quality, or suitability of Customer Content.
6. Messaging and Communication Compliance
Customers using TrustSignal to send SMS, WhatsApp, RCS, email, or other communications must comply with all applicable laws, regulations, industry requirements, carrier requirements, and policies of relevant messaging platforms.
Depending on the Service and jurisdiction, these requirements may include applicable:
- Telecommunications regulations;
- Data protection and privacy laws;
- Anti-spam requirements;
- Consumer protection laws;
- Do-not-contact and opt-out requirements;
- Sender registration requirements;
- DLT requirements;
- WhatsApp Business and Meta policies;
- RCS/RBM requirements;
- Email provider policies;
- Carrier rules; and
- Other applicable messaging ecosystem requirements.
TrustSignal may require documentation, undertakings, sender information, business verification, template information, consent evidence, or other information before enabling certain Services.
Failure to provide required information may result in delayed onboarding, rejection, suspension, or termination of the applicable Service.
7. Prohibited Uses
You must not use the Services for activities that are unlawful, fraudulent, deceptive, abusive, harmful, or that violate applicable third-party platform policies.
Prohibited activities include, without limitation:
- Sending spam or unsolicited communications;
- Sending communications without legally required consent;
- Phishing or impersonation;
- Fraud or deceptive schemes;
- Malware, malicious code, or harmful content;
- Content that facilitates illegal activities;
- Unauthorized collection or misuse of personal information;
- Circumvention of messaging platform restrictions;
- Artificial manipulation of delivery, engagement, or reporting metrics;
- Sending content intended to harass, threaten, or abuse recipients;
- Using the Services to infringe intellectual property rights;
- Attempting to compromise or disrupt TrustSignal infrastructure;
- Circumventing security or usage restrictions; or
- Any activity prohibited by applicable messaging platform or carrier policies.
TrustSignal reserves the right to investigate suspected violations and take appropriate action, including restricting or suspending Services.
8. Customer Content
You retain ownership of Content submitted by you through the Services.
You grant TrustSignal a limited, non-exclusive right to host, process, transmit, store, and otherwise use Customer Content solely to the extent necessary to provide, maintain, secure, troubleshoot, and improve the Services, or as otherwise permitted by applicable agreements and law.
You represent and warrant that you have all necessary rights, permissions, and consents required for TrustSignal to process Customer Content in accordance with these Terms.
TrustSignal does not claim ownership of Customer Content.
9. Data Protection and Privacy
TrustSignal may process personal information on behalf of Customers in connection with providing the Services.
Customers are responsible for determining the lawful basis for collecting and processing personal information and for providing appropriate notices to End Users where required.
Where applicable, the parties may enter into a separate Data Processing Agreement (“DPA”) governing the processing of personal data.
TrustSignal will maintain reasonable technical and organizational measures designed to protect information processed through the Services against unauthorized access, alteration, disclosure, or destruction.

10. Third-Party Platforms and Networks
Certain Services depend on third-party platforms, carriers, operators, cloud infrastructure providers, messaging networks, and APIs.
Examples may include messaging platforms, telecommunications operators, cloud service providers, and other infrastructure partners.
Third-party providers may independently modify their policies, pricing, technical requirements, delivery rules, availability, or access conditions.
TrustSignal is not responsible for changes, restrictions, suspensions, outages, or failures attributable to third-party platforms or networks.
Where a third-party provider imposes restrictions that affect your use of the Services, TrustSignal may implement reasonable changes or restrictions to comply with those requirements.
11. Message Delivery
Message delivery is dependent on multiple factors, including carrier networks, recipient availability, device configuration, network conditions, platform policies, content restrictions, sender reputation, traffic patterns, and third-party infrastructure.
Accordingly, TrustSignal does not guarantee that every message will be delivered, read, or acted upon.
Delivery reports and analytics may be based on information received from carriers, messaging platforms, or other third-party systems and may therefore be subject to their limitations.
12. Fees and Payment
Fees for the Services will be specified in the applicable Order Form, commercial agreement, pricing page, or other agreed commercial documentation.
Unless otherwise agreed:
- Fees are payable according to the agreed billing cycle.
- Usage-based Services may be charged according to applicable message, API, conversation, or service usage.
- Taxes, duties, levies, and applicable governmental charges may be charged in addition to the stated fees.
- Customers are responsible for providing accurate billing information.
- Overdue amounts may result in suspension of Services after reasonable notice.
Credits, prepaid balances, or virtual credits may be subject to the terms applicable to the relevant Service or commercial agreement.
Unless expressly stated otherwise, payments are non-refundable once the applicable Service or usage has been consumed.
13. Price Changes
TrustSignal may revise pricing from time to time.
Where a Customer has an existing commercial agreement or Order Form with defined pricing terms, those terms will continue to apply for the agreed period unless otherwise specified.
Changes resulting from carrier, messaging platform, regulatory, tax, infrastructure, or third-party pricing changes may be communicated separately where applicable.
14. Intellectual Property
TrustSignal and its licensors retain all rights, title, and interest in:
- The TrustSignal platform;
- Software and APIs;
- Technology and infrastructure;
- Documentation;
- User interfaces;
- TrustSignal trademarks and branding;
- Designs and workflows;
- Proprietary methodologies; and
- Other TrustSignal intellectual property.
Except for the limited rights expressly granted under these Terms, no intellectual property rights are transferred to the Customer.
You may not copy, modify, reverse engineer, decompile, disassemble, reproduce, resell, or create derivative works of the TrustSignal platform except where expressly permitted by applicable law or written agreement.
15. API and Technical Usage
Customers using TrustSignal APIs must comply with applicable technical documentation, rate limits, authentication requirements, and usage restrictions.
You must not:
- Attempt to bypass rate limits;
- Perform unauthorized security testing;
- Introduce malicious traffic;
- Attempt to gain unauthorized access;
- Reverse engineer the APIs;
- Use APIs to overload TrustSignal infrastructure; or
- Interfere with the operation of the Services.
TrustSignal may implement technical controls, throttling, rate limits, or temporary restrictions to protect platform stability, security, and availability.
16. AI and Automated Features
Where TrustSignal provides AI-enabled features, Customers remain responsible for reviewing and appropriately using AI-generated outputs.
AI-generated responses may contain inaccuracies or omissions and should not automatically be treated as professional, legal, financial, medical, or other specialized advice.
Customers are responsible for configuring AI features appropriately, including instructions, knowledge sources, workflows, escalation mechanisms, and human review where appropriate.
Customers must not use AI features for prohibited or unlawful activities.
17. Security
TrustSignal maintains security measures designed to protect the Services and Customer information.
Customers are responsible for maintaining appropriate security practices within their own systems, including access controls, API key protection, credentials, endpoint security, and authorized-user management.
No internet-based system can be guaranteed to be completely secure. TrustSignal does not guarantee that the Services will be immune from every possible security threat.
18. Availability and Service Levels
TrustSignal will use commercially reasonable efforts to maintain availability of the Services.
Where an SLA has been separately agreed with a Customer, the applicable SLA will govern service availability and remedies.
Scheduled maintenance, emergency maintenance, third-party outages, carrier failures, internet disruptions, force majeure events, Customer configuration issues, and other circumstances outside TrustSignal’s reasonable control may be excluded from applicable availability calculations.
19. Suspension
TrustSignal may suspend or restrict access to all or part of the Services where reasonably necessary to:
- Protect the security or integrity of the platform;
- Prevent fraud, abuse, or unlawful activity;
- Comply with applicable law;
- Comply with a third-party platform or carrier requirement;
- Address non-payment;
- Investigate suspected violations; or
- Protect TrustSignal, its customers, End Users, or third parties from harm.
Where reasonably practicable, TrustSignal will provide notice before suspension and an opportunity to remedy the relevant issue.
Immediate suspension may occur where necessary to address security, legal, fraud, abuse, or operational risks.
20. Termination
Either party may terminate the applicable Services in accordance with the applicable Order Form or commercial agreement.
TrustSignal may terminate or suspend Services where the Customer materially breaches these Terms and fails to remedy the breach within the applicable notice period.
Upon termination:
- Access to the relevant Services may cease.
- Outstanding fees become payable in accordance with the applicable agreement.
- Customer responsibilities relating to Content, confidentiality, intellectual property, payment, indemnity, and liability will survive where applicable.
21. Confidentiality
Each party may receive confidential information belonging to the other party.
The receiving party will use reasonable measures to protect confidential information and will use such information only for purposes connected with the business relationship.
Confidential information does not include information that:
- Is publicly available without breach;
- Was already lawfully known;
- Is independently developed; or
- Is lawfully received from a third party without confidentiality restrictions.
Confidentiality obligations will survive termination of the Services for the period specified in the applicable agreement or, where no period is specified, for a reasonable period consistent with applicable law.
22. Indemnification
To the extent permitted by applicable law, the Customer agrees to defend, indemnify, and hold harmless TrustSignal and its affiliates, officers, employees, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from:
- Customer Content;
- Customer’s unlawful or unauthorized use of the Services;
- Violation of applicable laws or third-party policies;
- Violation of these Terms;
- Infringement of third-party intellectual property rights by Customer Content; or
- Claims arising from Customer’s products, services, or communications.
The specific indemnification obligations may be modified by an applicable Order Form or master services agreement.
23. Disclaimer of Warranties
Except where expressly stated in a written agreement, the Services are provided on an “as available” and “as is” basis to the extent permitted by applicable law.
TrustSignal does not warrant that:
- The Services will operate without interruption;
- Every communication will be delivered;
- The Services will be error-free;
- Third-party networks or platforms will remain available;
- The Services will satisfy every Customer requirement; or
- The Services will be immune from all security threats.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
24. Limitation of Liability
To the maximum extent permitted by applicable law, TrustSignal will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data arising from or related to the Services.
TrustSignal’s aggregate liability arising from the Services will be limited to the amount paid or payable by the Customer to TrustSignal for the applicable Services during the period specified in the applicable commercial agreement, subject to applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Where an Order Form or Master Services Agreement contains different liability provisions, those provisions will prevail.
25. Force Majeure
TrustSignal will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, acts of government, war, civil unrest, telecommunications failures, internet disruptions, power failures, cyber incidents affecting third-party infrastructure, carrier outages, platform outages, strikes, epidemics, or other force majeure events.
26. Changes to These Terms
TrustSignal may update these Terms from time to time.
The updated version will be published on the TrustSignal website with a revised “Last Updated” date.
Where legally required or where changes materially affect an existing contractual relationship, TrustSignal may provide additional notice.
Continued use of the Services following the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by law.
27. Governing Law and Jurisdiction
These Terms will be governed by the laws applicable to the TrustSignal contracting entity and as specified in the applicable Order Form or commercial agreement.
Unless otherwise agreed in writing, disputes will be subject to the jurisdiction and dispute-resolution mechanism specified in the applicable commercial agreement.
28. Notices
Notices relating to the Services may be delivered through the Customer’s registered email address, account notifications, the TrustSignal platform, or other contact information provided by the Customer.
Customers are responsible for keeping their contact and billing information current.
29. Assignment
You may not assign or transfer your rights or obligations under these Terms without TrustSignal’s prior written consent, except where permitted under an applicable commercial agreement.
TrustSignal may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, or similar transaction.
30. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.
31. Entire Agreement
These Terms, together with any applicable Order Form, Master Services Agreement, DPA, SLA, pricing agreement, and other incorporated documents, constitute the agreement governing your use of the Services.
Where there is a conflict between documents, the order of precedence will be determined by the applicable commercial agreement.
